These Terms of Service ("Terms") govern your use of GravityPing ("the App"), operated by SimbaApps LLC, a Delaware limited liability company ("SimbaApps," "we," "our," or "us").

By downloading, installing, or using GravityPing, you agree to these Terms. If you do not agree, do not use the App.

GravityPing is a fermentation gravity check reminder app for homebrewers. It sends scheduled reminders to help you track gravity readings throughout your fermentation cycles.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use GravityPing. By using the App, you represent that you meet this requirement and have the legal capacity to enter into this agreement.

If you're using GravityPing on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Account Terms

2.1 Registration

To access certain features of GravityPing, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account information up to date
  • Maintain the confidentiality of your login credentials
  • Notify us immediately at support@simbaapps.com if you suspect unauthorized access

2.2 Account Responsibility

You are responsible for all activity that occurs under your account. SimbaApps is not liable for losses resulting from unauthorized access due to your failure to secure your credentials.

2.3 One Account Per Person

You may not create multiple accounts to circumvent service limits, restrictions, or payment requirements. One email address per account.

3. Free and Premium Services

3.1 Free Tier

GravityPing offers a free tier with access to core features at no cost. The free tier is provided "as is" without any SLA or guaranteed uptime. We may modify, limit, or discontinue free tier features at any time with reasonable notice.

Free tier includes:

  • 1 active fermentation cycle at a time
  • Email reminders on default schedule (Tuesday, Thursday, Saturday)
  • Basic gravity reading log
  • Community support via support@simbaapps.com

3.2 Premium Features

Certain advanced features require a paid subscription ("Premium"):

  • Up to 5 active fermentation cycles simultaneously
  • SMS & WhatsApp reminders — receive notifications directly on your phone
  • Custom check schedule — choose any days and times that fit your brew day routine
  • Escalation nudge — get a follow-up reminder if you miss a scheduled gravity check

3.3 Billing

  • Payments are processed by Stripe
  • Subscriptions renew automatically at the end of each billing period (monthly or annual, as selected)
  • Monthly plan: $2.99/month
  • Annual plan: $24/year (save ~33%)
  • All prices are listed in USD and are exclusive of applicable taxes
  • You authorize SimbaApps to charge your payment method on the agreed billing cycle
  • You are responsible for all taxes associated with your purchase

3.4 Refunds

We offer a 7-day money-back guarantee for new Premium subscriptions. If you're not satisfied within your first 7 days, contact support@simbaapps.com for a full refund. After 7 days, payments are non-refundable except as required by applicable law.

3.5 Cancellation

You may cancel your subscription at any time from the App's account settings. Cancellation takes effect at the end of your current billing period. You retain Premium access until the period ends. No proration for mid-period cancellations.

3.6 Pricing Changes

We may change Premium pricing. If your subscription price changes, we will notify you at least 30 days in advance via email. You may cancel before the new price takes effect.

4. Acceptable Use

You agree to use GravityPing only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable local, state, national, or international law or regulation
  • Infringe on any intellectual property, privacy, or other rights of any person
  • Upload, transmit, or store content that is illegal, harmful, defamatory, or obscene
  • Harass, threaten, bully, or intimidate other users
  • Impersonate any person, organization, or entity
  • Attempt to gain unauthorized access to any part of GravityPing or its underlying infrastructure
  • Reverse engineer, decompile, or disassemble any part of the App
  • Scrape, crawl, or extract data from the App without written permission from SimbaApps
  • Use the App to train machine learning models without explicit written consent from SimbaApps
  • Distribute spam, malware, or any harmful code through the App
  • Interfere with or disrupt the integrity or performance of the App or its servers
  • Create automated accounts or use bots to access the App without authorization
  • Resell, sublicense, or commercialize your access to GravityPing without our written consent

We reserve the right to investigate violations and take appropriate action, including suspension, termination, and referral to law enforcement.

5. Intellectual Property

5.1 SimbaApps IP

SimbaApps LLC owns all rights, title, and interest in GravityPing, including all software, code, designs, logos, trademarks, and content we create. These Terms do not grant you any right to use our brand, trademarks, or proprietary technology outside of normal app use.

5.2 Your Content

You retain ownership of all content you create, upload, or store in GravityPing ("User Content"). By submitting User Content, you grant SimbaApps a limited, non-exclusive, royalty-free license to host, store, process, and display your content solely for the purpose of providing the App's services to you. This license ends when you delete your content or your account.

5.3 Content Standards

You represent that your User Content:

  • Is owned by you or you have the right to use it
  • Does not infringe on any third-party intellectual property rights
  • Does not violate any applicable law

5.4 Feedback

Any feedback, suggestions, or feature requests you share with us may be used by SimbaApps to improve the App without restriction or compensation to you.

6. Privacy

Your use of GravityPing is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in our Privacy Policy.

7. Third-Party Services and Links

GravityPing may integrate with or link to third-party services. These integrations are subject to the respective third party's terms and privacy policies. SimbaApps is not responsible for the practices, content, or availability of third-party services.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance (with advance notice where possible)
  • Conduct emergency maintenance without notice if required for security or stability
  • Modify, suspend, or discontinue features with reasonable notice

SimbaApps is not liable for any losses resulting from service downtime.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS.

SIMBAAPPS DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SIMBAAPPS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
  • DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP

IN ANY CASE, SIMBAAPPS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU PAID TO SIMBAAPPS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless SimbaApps LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of or access to GravityPing
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Termination

12.1 By You

You may delete your account at any time from the App's settings. Upon deletion, your personal data will be removed per our Privacy Policy.

12.2 By Us

SimbaApps may suspend or terminate your access immediately, with or without notice, for:

  • Violation of these Terms or any SimbaApps policy
  • Suspected fraud, abuse, or illegal activity
  • Non-payment of fees owed
  • Extended inactivity (free accounts inactive for 24+ consecutive months)
  • Any other reason necessary to protect the App, its users, or SimbaApps

If we terminate your account without cause, we will refund any prepaid fees for unused subscription time.

12.3 Effect of Termination

Upon termination, your license to use GravityPing ends immediately. The following sections survive termination: Sections 5 (IP), 9 (Disclaimers), 10 (Liability), 11 (Indemnification), and 14 (Governing Law).

13. Changes to These Terms

We may update these Terms at any time. For material changes, we will:

  • Update the "Last updated" date
  • Notify you via email or in-app notification
  • Provide at least 14 days' notice before changes take effect

Continued use of GravityPing after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you must stop using the App and delete your account.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

14.2 Informal Resolution

Before pursuing formal dispute resolution, you agree to contact support@simbaapps.com and give us 30 days to resolve the issue informally.

14.3 Binding Arbitration

If we can't resolve the dispute informally, both parties agree to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with proceedings in Delaware (or by video conference). Each party bears its own costs unless the arbitrator decides otherwise.

14.4 Class Action Waiver

YOU AND SIMBAAPPS AGREE THAT ALL DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION FOR ANY CLAIMS COVERED BY THESE TERMS.

15. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy and any product-specific policies, constitute the entire agreement between you and SimbaApps regarding GravityPing.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any provision is not a permanent waiver of that right.
  • Assignment: You may not assign your rights under these Terms. SimbaApps may assign its rights in connection with a merger, acquisition, or asset sale.
  • Force Majeure: SimbaApps is not liable for failures caused by events beyond our reasonable control.
  • Language: These Terms are written in English. Any translations are provided for convenience only; the English version controls.
